Terms of Service

1. Introduction
Welcome to HallPass (“the Platform”), a school check-in and check-out management service operated by HallPass (Pty) Ltd (“we”, “us”, “our”), a South African company.
By registering for, accessing, or using HallPass, you (“User”, “you”) agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the Platform.
These Terms apply to all users, including school administrators, staff members, and parents/guardians.
2. Description of Service
HallPass provides a digital platform for schools to manage the check-in and check-out of children. The service includes:
- QR code and PIN-based gate verification
- Real-time attendance tracking and notifications
- Authorized person management for child pickup
- Attendance reports and analytics
- Parent and staff communication tools
3. User Accounts and Registration
To use HallPass, you must register an account and provide accurate, complete information. You are responsible for:
- Maintaining the confidentiality of your login credentials and PIN
- All activity that occurs under your account
- Notifying us immediately of any unauthorized use
- Ensuring that the information you provide is accurate and up to date
School administrators are responsible for managing user access within their school, including approving parent registrations and managing staff accounts.
4. Data Hosting and International Transfers
Consent to International Data Hosting
By using HallPass, you acknowledge and consent to your personal information being processed and stored on secure cloud infrastructure operated by third-party providers (such as Vercel, Railway, and Neon/PostgreSQL hosting services), which may be located outside of the Republic of South Africa, including but not limited to servers in the United States, the European Union, and other jurisdictions.
We ensure that all international transfers of personal information comply with the Protection of Personal Information Act, 2013 (POPIA) and that adequate safeguards are in place, including:
- Encryption of data in transit (TLS 1.3) and at rest (AES-256)
- Use of reputable cloud providers with enterprise-grade security certifications (SOC 2, ISO 27001)
- Strict access controls limiting data access to authorized personnel only
- Regular security audits and monitoring
- Data processing agreements with all third-party providers
5. Data Collection and Privacy
We collect and process personal information as described in our Privacy Policy. By using HallPass, you consent to the collection, use, and processing of your personal information in accordance with POPIA and our Privacy Policy.
The types of personal information we collect include:
- Contact information (name, email, phone number)
- Child information (name, class, medical/allergy notes)
- Attendance records (check-in/out times, methods used)
- QR tokens and hashed PINs for verification
- Authorized person details for child pickup
We do not collect location data, biometrics, browsing history, or advertising data. Your data is never sold to third parties.
6. Acceptable Use
You agree not to:
- Share your QR code or PIN with unauthorized individuals
- Attempt to access another user’s account or data
- Use the Platform for any unlawful purpose
- Interfere with or disrupt the Platform’s operation
- Attempt to circumvent security measures
- Use automated tools to scrape or access the Platform without authorization
7. School Responsibilities
Schools using HallPass are responsible for:
- Obtaining appropriate consent from parents/guardians for their children’s data to be processed
- Ensuring staff are trained on proper use of the gate check-in system
- Managing user access and promptly removing access for departed staff or withdrawn children
- Complying with all applicable education and data protection laws
8. Parent/Guardian Responsibilities
Parents and guardians are responsible for:
- Keeping their QR code and PIN confidential
- Maintaining an accurate list of authorized persons for child pickup
- Promptly updating their information when changes occur
- Submitting absence or late notices timeously
9. Custody & Family Law Disclaimer
Important Legal Notice
HallPass is not a legal custody management system. HallPass does not verify custody arrangements or court orders, determine which parent has legal authority over a child, or enforce or interpret any court order, parenting plan, or custody agreement.
It is the responsibility of each parent/guardian to:
- Only register children for whom they have legal authority
- Only authorize persons consistent with any applicable court orders
- Inform the school directly of any custody restrictions
- Provide the school with copies of relevant court orders
The school is responsible for:
- Implementing custody restrictions at the operational level
- Configuring the system according to court orders provided to them
- Making judgment calls when custody disputes arise at the gate
HallPass (Pty) Ltd and its operators accept no liability for releasing a child to a parent or authorized person in contravention of a court order that was not communicated to and configured by the school, or for any dispute between parents regarding custody or access.
10. Service Availability
We strive to maintain high availability of the Platform but do not guarantee uninterrupted access. The Platform includes offline capabilities for gate operations, but certain features require an internet connection.
We may perform maintenance, updates, or modifications to the Platform from time to time, which may temporarily affect availability.
11. Intellectual Property
All content, software, and materials on HallPass are the property of HallPass (Pty) Ltd or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Platform.
12. Limitation of Liability
To the maximum extent permitted by South African law:
- HallPass is provided “as is” without warranties of any kind, express or implied
- We are not liable for any indirect, incidental, or consequential damages arising from your use of the Platform
- Our total liability shall not exceed the amount you have paid us in the 12 months preceding the claim
- HallPass is a digital tool to assist with attendance management and does not replace the physical duty of care owed by schools and parents to children
13. Termination
You may stop using HallPass at any time. Schools may request account deletion by contacting us. We may suspend or terminate accounts that violate these Terms.
Upon termination, we will retain your data only as required by law or for legitimate business purposes, after which it will be securely deleted.
14. Changes to These Terms
We may update these Terms from time to time. We will notify registered users of material changes via email or in-app notification. Continued use of HallPass after changes constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the jurisdiction of the South African courts.
